Working when on a Visitor Visa

Hi David, I've pasted your previous response below. I can gain work with an Australian transcription company and work from home in Canada.

My query now is that I did not think it was legal to work when on a visitor visa? As it is unlikely I will gain a letter of contract from the company before I am in Canada (as I won't be working for them UNTIL I'm in Canada) what do I say to Immigration when landing in Canada about working from home when I am supposed to be on a visitor visa? I did not imagine they would allow me in, or is working from home and working for an Australian company a different story?

Whether or not you would be considered self-employed would depend on the structure of your agreement with the company.

Otherwise, if your employer is a Canadian one, then the standard requirements for a work permit would apply (i.e., LMO and then work permit application), even if it is a home based position. If your employer is a foreign company with no Canadian division, then no work permit would ordinarily be required; you would be responsible to obtaining and maintaining temporary resident (visitor) status, however.

The response to your inquiry seems to be already stated below:

"If your employer is a foreign company with no Canadian division, then no work permit would ordinarily be required."

In such a case, visitor admission alone is sufficient.
