Work permit application-- uncommon situation

Hello,

I got situation. I'm a business visitor to Canada for one year working on a joint Russian-Canadian project as consultant/analyst. I was offered position of software developer and got positive LMO.

Company sent application for work permit for me to Vegreville, however it was refused with following explanation: 'You are not a person who can apply for this type of document from within Canada. An application of this type must be made at a Canadian Visa office in another country'.

So I can't change status from visitor to working via inside processing. Can I just resend application by mail to one of the US offices (Seattle or Buffalo) and get positive decision from there? (similar to people applying to Buffalo for PR). I'm already in BC at my future employer, so applying at country of residence or port of entry sounds strange here.

I have some time until my visitor status expire, also I don't have any status in the US. If this application possible can such procedure require an interview in the US? Do I need to get TRV, extend my visitor status or getting work permit implies that automatically? (I'd like to apply to Seattle, but they introduced biometrics trial for TRV-- i don't know if that matters).

You may submit the case to one of the visa offices in the USA, which could require that you attend an interview at that location. You should be granted a new TRV if approved, but would not be required to extend your current visitor record.
