Hey there i am after a bit of advice,

I am currently living and working in Canada on a Working Holiday Permit from New Zealand, my current entitlement to work will end in September.

Before this time i will have an application into CIC for a study permit as i am applying to start studying in January 2012 at an Alberta University.

My question is this, if i get the study visa application in before my current work permit expires will i have implied status to continue working until a final decision is made on my application?

If not, what options do i have to continue working until i commence my studies? i have an employer who wants me to stay as long as possible and is relying on me to be here until school starts, they have in the past offered to sponsor me to move permanently but i declined in order to finish my schooling first.

i will have been working for them for almost 1 year as an on site Surveyor in the oil and gas construction industry, although i am not fully qualified in this field (i still have two at years of schooling left, and this is what my study visa will be for). i also hold a Management degree from my university back in New Zealand. What class of position would i be considered for if the employer and i were to apply for an LMO?

If not seeking renewal of your work permit, the provisions of implied status would not apply. To continue working, as WHP visas are not generally renewable, a LMO and new work permit or change of terms would be needed.
