Want to get married ASAP

Postby Jonny19 on Sun Jan 15, 2006 7:17 pm

Hi,
My situation is somewhat detailed but here are the basics.
I am a US Citizen living in the us. My fiance is a Kenyan Citizen doing volunteer work in Canada with a work/education visa... but her papers do not allow her to earn an income. I have no status in Canada. We are looking to get married as soon as possible and would prefer to live in canada.

A friend of ours owns a few companies in the US and Canada. He offered to hire me through the canadian development company to plan and build the facility. His Canadian Development Company has been in existence for a few years with multi million dollar projects in and around Victoria. Once the facility is built then his US company would start another Canadian company to run a business out of that facility. That new canadian company would then seek to have me come on as a permanent hire with permanent residence.

A couple questions:
1. Is this a logical way to get me into canada?
2. I qualify under the points system as a skilled worker... is it quicker for me to come in under a temp worker visa and apply for skilled worker or start off the bat by attemptin to get in as a skilled worker... what is the time frame for both scenarios? How long should the temp visa state my work will take so that I do not have to leave while I am applying for a skilled worker visa?
3. What difficulties might transferring companies, or doing it in this manner have?
4. How long can I get a temp work visa... ideally I would be able to stay in Canada while i attempt my skilled worker visa which takes about a year I am told.
5. If I got the job would we be able to get married and have her remain in Canada on my status?
6. Would we be able to apply for a US greencard once we are married without much difficulty?
Thanks for your asssistance.
Sincerely,
Jon

A temporary work permit is a faster way to be legally eligible to live and work in Canada. It is not a means of circumventing the requirements of permanent resident status, but does meet a more immediate need when the situation exists.

A permanent resident application takes much longer, but has the advantage of allow for a longer stay (i.e., permanent) and the possibility of seeking citizenship. In contrast, a typical work permit has a maximum validity of one year, although exceptions exist.

If you obtain a work permit, then a spouse or common-law partner could typically accompany you to Canada as a temporary resident, potentially with her own work permit.
