USA employee being sent to CA customer

Postby randallspicher on Sun Jan 09, 2011 2:33 pm

I work for a software company in the USA, and am being sent to assist one of our customers in Quebec. (Part of the contract is that we can provide development assistance for creating a system based on our product, and I'm one of the people who get sent to customers to do that). I fly in weekly, and for the past 3 weeks have just been entering as a business visitor. However, I'm expected to be going there for the next 3 months, and am not sure if that's going to start to cause a problem when the customs officers start to recognize me...

Would I need a work Visa for this? Or could I just continue as a business visitor? (since I won't be residing in CA, or be working directly for an employer there)

As the Canadian company is a customer of the products or services of your foreign employer, yes a work permit is a requirement. The fact that you do not necessarily reside in Canada or that you are not a direct employee of the Canadian company does not have a bearing on this.
