Urgent Help -Open work permit extension

Postby TruptiJ on Sun Dec 05, 2010 3:31 pm

Hello,

I am a dependent on my husband's work visa and had an open work permit which expired on 12th August 2010(as my husband had a work permit till this time). My husband's work permit was applied for extension on 12th June 2010 through his employer. They applied for my "visitor extension" ONLY but not my work permit extension as it does not fall under their policy. Hence, before my work permit expired, I applied for my work permit extension on 7th August 2010. However, I got into a job on implied status.
After 2 months, when I din't receive the work permit, I called the CIC office and was told that my husband's work permit was delayed by 16 weeks. On 25th November 2010, we finally received my husband's work permit extension and my stay extension ONLY which specifically mentions 'prohibited from employment in Canada'. However, I haven't received my work permit yet and my employer has been asking for my work permit and SIN.
1) Is this a normal scenario? Is it legal for me to continue working as the visitor record prohibits me from working?
2) Will I receive my work permit extension or will it be rejected?
2) How do I prove to my employer about my work-in-progress as CIC only gives general information about implied status?

Thank you for your help in advance

The visitor extension may have been processed prior to any consideration of your work permit extension request, as it was received earlier. Assuming that there is nothing hindering your work permit request, it will likely follow your visitor extension by approximately a month. You would need to contact CIC to determine its status.

Unfortunately, CIC does not supply any documents which clearly confirm eligibility to work under implied status. Evidence of the submission of an extension and reference to Regulation 186(u) may be the best that an individual can do in that situation.
