Transfer of work permit

Postby meetnairnilesh on Fri Feb 24, 2006 3:22 pm

Hi,
I am currently working for a company in Toronto on a work permit (intra- company transfer) which expires in June 2006.
My company plans to extend my stay by renewing the visa.
Suppose, I get a job offer from a new employer, how should I go about changing my work permit to the new employer.

Thanks
Nilesh

You would have the option of pursuing an inland change of terms via the CPC in Vegreville, or submitting an application for a new work permit via a visa office outside of Canada. The inland process does not require you to leave Canada but takes considerably longer than an application processed at most visa offices abroad. The delay associated with an inland application may not be appealing to the new employer.

Hi David,
Thanx for your prompt reply.
Is is possible to be in Toronto, and submit an application for new work permit / transfer of existing work permit at Bufallo (US) office.
Or something like crossing over the border (at Niagra falls) and then re-entering Canada on a new work permit.
The issue here is that I do not have a US Visa, and getting one now will take some time. So my worry is that crossing over to US will be a problem unless there is some arrangement where you dont need to actually enter US but be physically present at the immigration check point at the border of Canada and US and then the authorities release a new work permit.
Please advice.

Thanks

If you are a legal temporary resident of Canada (i.e., residing in Toronto), it is possible to usa a visa office in the USA for the submission of a work permit application.

Only individuals exempt from the requirement of a Canadian passport (visitor) visa can apply for a work permit at a port of entry. Canada's immigration officials may insist that an individual first enter the USA before returning to a port of entry at the border to process a work permit. Refusal of admission to the USA would be sufficient for this purpose, however, but could also impact subsequent attempots to travel there.
