Telecommute from Canada for US Employer

Hi,

I am an Indian citizen currently working in the US on H1B as a Software Developer. Due to family reasons, I have to telecommute from Canada for my US Employer. What visa should I apply to telecommute from Canada indefinitely (the US Employer does not have any affiliation, partner, etc in Canada). What visa should I apply for my dependent spouse (also Indian citizen) and my US citizen child? Can my spouse (also a software developer) work in Canada?

A Canadian work visa is not needed for telecommuting work for a foreign company with no presence in Canada. There is therefore no work permit provision that would apply to your situation. You may seek temporary admission as a visitor (which is a risky endeavour, especially in the long term) or via a permanent resident application potentially (assuming eligibility).

Your spouse could potentially work in Canada if she obtained a job offer from a Canadian company. She would need a work permit, the issuance of which could allow for your own open work permit.
