Spouse Work Permit

Postby HSingh on Sun Apr 10, 2011 9:05 pm

Hello,
This is Simran and I am working and living in Canada on a Post graduation work permit which is valid till 2013. I am doing a job which falls under NOC skill level B and I had also applied for Permanent residence of Canada at Buffalo for me and my wife under Provincial Nominee category. Now I want to apply for my spouse who is living in India under work permit and I have a couple of Questions regarding that:
1. Is she is eligible to apply for a work permit from India
2. Second if she is eligible what documents she needs to attach to support her application from her side in India and from me in Canada

Please help me on this. I shall be very thankfull to all of you.
Once again thanks for your time.

If you received a nomination under a provincial program, then your spouse could be entitled to seek an open work permit under the Spouses or common-law partners of skilled workers provisions regardless of skill level of your occupation. If you do not have nomination, and can demonstrate that you are doing work classified as high skill, then the same provisions should apply. Specific documentation requirements must be ascertained from individual visa offices.

Spouses of foreign students are often eligible for open work permits in Canada for the duration of such studies. The nature of the institution and the duration of the studies may impact this.
