My background
- I finished my Bachelor of Computer Science (4 yrs) in Canada
- After my graduation, I have started to work under “Post Grad Program” (expired on September 26, 2005) in Ontario.
- My Skill Worker Permanent Residents application is still in process in Buffalo

My lawyer has submitted an application in Buffalo, NY as a “Software Developer – Services (NOC 9990.5)” for the same employer I was working under the “post grad program”. My employer has provided my lawyer with all the documents necessary to extend my work permit.

It has been couple of weeks (over 3 weeks) and still waiting for a decision from Buffalo. I would like to know-

Is there any possibility that Buffalo consulate might ask me to travel to USA for an interview? Is there any way to avoid this interview?

Is it possible that Buffalo consulate will mail me the work permit if they are satisfied with all the documents?

I ask because, if I have to go to USA I have to get a US visa and the processing time is over two months.

Yes, it is possible that the visa office may request an interview if any issues about the case need to be resolved. If no issues exist, they would not mail you the work permit itself, however. The visa office would mail the approval of the application, but the visa itself would have to be obtained at a port of entry when arriving from outside of Canada.

But i am still in Canada. If i have to go outside Canada that means i will require a visa to get back in right?
Is the Buffalo consulate going to request my passport to stamp the visa?

In certain cases, temporary residents returning from the USA after short trips may be eligible to re-enter Canada without the need of a new visa. This is applicable only if your original visitor visa remains valid.

The Buffalo office would generally require your passport to issue a visitor visa. The work permit itself will only be issued at the port of entry.
