Question Regarding Open Spousal Work Permit

Postby scable-mit on Tue Jun 19, 2007 1:10 pm

Hello,

I have a question concerning spousal work permits that I was hoping someone here might be able to help me with.

I am a US citizen who has recently accepted a postdoctoral fellowship at the University of British Columbia. I am currently completing my application for a Canadian work permit.

I have heard from numerous sources that my wife can also apply for an "open" spousal work permit. However, neither the University nor the CIC's own website has any clear statement on how this is done. I have also contacted the consulate in Buffalo, but I was merely redirected back to the CIC website.

What is the procedure for obtaining an "open" work permit for my wife? Can she apply at the same time that I apply for my own work permit (i.e., from America, ahead of time)? What forms does she use?

Any help that any of you might be able to offer would be very greatly, deeply appreciated.

Best,

Seth Cable.

Such applications are based on evidence of a spousal relationship and evidence that your work permit is granted under a National Occupational Classification which is considered "skilled." Such a case may be processed at a visa office concurrent to your own application at a port of entry for a US citizen.

We had the same problem. That part is not clear at all. Your spouse should include a letter stating:
"I am applying for an Open Spousal Work Permit as the spouse of a highly-skilled individual, XXX, whose occupational level is O, A or B."

along with your application. Also include his/her passport and proof of common law partnership (like marriage certificate) There might be other required documentation. You should check from the web site. But the spusal application is just that letter. We received our work permits recently. Good luck!
