Port of Entry Work Visa

Postby wilsonwhiterock on Tue Oct 19, 2010 2:21 pm

I am a UK citizen and passport holder.
Married to my Canadian wife who has returned urgently to Canada to be with her son and to run an Incorporated business which we both have 50% ownership of.
My current employer who I have been with for a year, has offered me a job in Canada doing the same role, which is specialised in Transport ICT and Applications.
Applying for a work visa from the UK can take 2 months and my employer would prefer me to start in 2- 3 weeks time.
Would there be any problems receiving a work visa at the Canadian Port of Entry and what documents would I need ?

Thanks

You will likely need a Labour Market Opinion in order to be granted a work permit in the position you are describing. Assuming this is correct, applying for the work permit at the port of entry is viable, so long as the LMO has been approved first.

According to the CIC site and others , if it is an Intra Company Transfer it is exempt from LMO and HRSDC.

My role is working for a Global Software and Applications company to develop new business in Transport and Logistics, particularly, rail, air and road logistics. This will involve managing people in Canada. We already have 2 offices in Canada.

Is it your belief that I would still need an LMO ?

Thank you

There is not enough information supplied to determine that the intra-company transfer provisions would apply. Factors such as the presence of substantive business operations in Canada and abroad, the corporate relationship, and the level of specialized or advanced skills needed for the position would be needed.
