Please HELP ME! I'm out of status and so confused....

Postby maybhe on Mon Nov 29, 2010 9:11 pm

Hi! I am presently out of status and I'm being asked to leave canada immediately but I don't want to process my new Working Permit in my country coz' I know it would take me forever to do that. Here's my questions and I will be very thankful for your answers:

1. I have an approved LMO, can I just exit at Montana, Alberta (US boarder) and apply a Working Permit from there?

2. If I can't exit in Montana, where in the appropriate US boarder should I exit? Can you please be kind to name some? I'm from Edmonton, Alberta by the way.

3. Any tips on what proper documents to bring and questions they usually asked so that I am ready?

Thank you so much hope to hear from you.

Ms. Confused

If you are passport-visa exempt (see current country list below), then you can apply for your work permit at a port of entry. Otherwise, the application will have to be submitted to a visa office outside of the country. You should bear in mind that, in applying at a port of entry when coming from within Canada, you may be asked to show evidence of your valid status in Canada at that time.

Persons who are passport-visa exempt include:

* citizens of Andorra, Antigua and Barbuda, Australia, Austria, Bahamas, Barbados, Belgium, Botswana, Brunei, Croatia, Cyprus, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Israel (National Passport holders only), Italy, Japan, Korea (Republic of), Latvia (Republic of), Lithuania, Liechtenstein, Luxembourg, Malta, Monaco, Namibia, Netherlands, New Zealand, Norway, Papua New Guinea, Poland, Portugal, St. Kitts and Nevis, St. Lucia, St. Vincent, San Marino, Singapore, Slovakia, Solomon Islands, Spain, Swaziland, Sweden, Slovenia, Switzerland, United States, and Western Samoa;
* persons lawfully admitted to the United States for permanent residence who are in possession of their alien registration card or can provide other evidence of permanent residence;
* British citizens and British Overseas Citizens who are re-admissible to the United Kingdom;
* citizens of British dependent territories who derive their citizenship through birth, descent, registration or naturalization in one of the British dependent territories of Anguilla, Bermuda, British Virgin Islands, Cayman Islands, Falkland Islands, Gibraltar, Montserrat, Pitcairn, St. Helena or the Turks and Caicos Islands;
* persons holding a British National (Overseas) Passport issued by the Government of the United Kingdom to persons born, naturalized or registered in Hong Kong;
* persons holding a valid and subsisting Special Administrative Region passport issued by the Government of the Hong Kong Special Administrative Region of the People’s Republic of China; and
* persons holding passports or travel documents issued by the Holy See.

Thank you David. If I can't cross the boarder because I dont have a US visa and I'm currently out of status now can I use a third party representative to do everything for me? If I can send my friend who is a canadian citizen to process my application for working permit and temporary resident visa, would it work? Would they acknowledge it? And can you suggest anything else for me to do rather than going home in my country and wait for my papers to be released after a couple of months?

Thanks for being so helpful David best regards!
