1. Can an employer give a permanent offer letter to someone who is on open work permit.
2. Can a permanent offer letter be submitted for the purpose of applying for extension of work permit (more exactly: going from an open work permit to a closed one)

Note: this is for a Software developer position which does not need LMO

As a job offer is not evaluated by immigration officials when an open work permit exists, the wording of such would not be an issue. However, when you seen change-of-terms and/or extension of a work permit, a statement of a permanent position can be problematic as it is contrary to the intent of the foreign worker program. An immigration official reviewing such a case may feel that a permanent resident application should be pursued and not a work permit.
