Open work permit; some questions

Hello,

I have a work permit which will expire on July 25, 2007. My wife is planning to apply for an open work permit under the Spousal Program next month, February. Will there be a major problem with her application considering the length of processing time (about 2 months) and the expiration of my work permit?

I was informed by my employer, however, that he is going to apply for the renewal of my work permit and is considering to hire me permanently.

Your wife can seek an open work permit for up to July 25th, the same date of expiration as your own permit. The proximity of your expiration is not necessarily a problem, although it may be worth considering alternate avenues of processing of the case (e.g., a visa office or port of entry).

Hi Elino,

The OWP will only be processed once u get AIP during the sponsorship process, currently taking 9 to 10 months. However, u will have implied status till the time u get ur OWP. Thus if u file ur spousal application together with the OWP application u can continue working till u receive an OWP even though it might take 10 to 11 months. This is a relatively new rule and we have sorted out the details of this here:

MAKE SURE U INCLUDE OWP APPLICATION IN SAME ENVELOPE, otherwise it might get processed and rejected right away. contact me thru settlement.org if u need help.
