My spouse is working in Canada and has an open work permit. Her job qualifies for NOC A category. Both of us are Citizens of India. I currently live in USA and have a valid TRV V-1 (visitor) visa for Canada. Can I apply for open work permit?

If yes then would I need a job offer or LMO to apply for work permit?

What is the time frame associated with Open work permit processing?

Can I apply from outside Canada (US location) or do I have to enter Canada and then apply?

After I get my work permit, do I have to change my visa status from TRV V-1 (visitor) to something else?

If your spouse is a foreign worker in Canada with a work permit valid for more than 6 months and doing work that is classified as NOC-A, then you may seek an open work permit with the same expiration as hers. The work visa FAQ addresses otherwise.

Thanks David for your prompt reply. Just to highlight, my spouse has a post-graduation work permit(since she graduated from a Canadian University). Does that change anything?

I was just concerned as post-graduation work permit might be different than regular work permit.

The wording of these provisions does not exclude specific types of work permit holders. The definition of eligibility is based on "doing work" classified as high skill as opposed to holding a work permit specific to a high-skill occupation.
