Open Work Permit

I am aware that there is a Spousal Program where a common law partner may apply for an Open work Permit without the need of a LMO; however I am not sure how it works or what the process entails.

Can someone apply for the open work permit if their spouse or common law partner is Canadian?

No, the program that you refer to is only for spouses/partners of certain foreign workers. It is not applicable if your spouse is a Canadian.
