Open Spouse Work Permit Refused

Postby Ravi Shankar on Tue May 04, 2010 9:31 pm

Hi All,

The work permit application of my wife was refused recently (30th April), citing the reason that she had not provided “proof of entry into Canada as required”. I would really appreciate your feedback/suggestions on the next steps and any pre-emptive actions we should take to ensure that she gets her work permit in the next attempt.

To provide some context, let me give a brief background. I have been working in Canada since Aug 2008 and recently my work permit was extended till Feb 2012. My wife is currently in Canada on a visitor visa (dependent), which is valid till 20th July 2010. After her arrival, she had applied online for open spouse work permit and had submitted her passport copy (front and last page). She had provided the reference to my work permit while applying for hers.

It may also be noted that my work permit was obtained under intra-company transfer provisions (not sure if that would make any difference to her case) and her visa application (TRV) for Canada had been rejected twice earlier, and finally she received her 6-months single entry visa.

For the current refusal, although they have clearly indicated the reason for refusal, they have not provided the next step.
1. Should we re-apply for the work permit?
2. Can we submit the documents against the previous application considering that the processing time for her application was more than 50 days.
3. What all documents we need to submit to make sure that the application gets accepted this time?

Thanks.
