Normal Work Permit, extension of working holiday or other

Postby Skvader on Tue Jan 10, 2012 9:50 pm

Hi. I am in a situation where I plan to return to the employer I had last summer in Canada, working in the months june to august. At that time I was working with a permit issued through International Experience Canada for Swedish citizens. It expires 14 june 2012. It seems it is not possible to extend such a permit to cover the whole of the summer of 2012 ? I have read that some students are exempt from work permits or labor market opinions.
I am currently an exchange student at Université de Montréal and my student visa is valid until 31 aug 2012. It follows that I have received a CAQ for the student visa, the job I would undertake in summer will be in the province of Québec, in the restaurant sector. What solution is recommended, the normal procedures to obtain a work permit or something related to my status either as student or as obtaining an open work permit ?

In some cases, full-time foreign students can work part time off campus without a work permit. It is not clear that this applies to you or if part time word would suffice for your needs.

Graduating foreign students can become eligible for open work permits under the post-graduation work permit program. Again, it is not clear if this applies to you.

If none of the above are suitable, then you will likely need to secure a Labour Market Opinion approval and Certificat d'acceptation du Québec prior to being able to seek the work permit.

OK, since I am an exchange student, the regime of Off Campus Work Permit don't apply to me. What I would like to know however is if being married to a canadian citizen diminishes the paper work necessary to work temporarily in Canada ? Me and my partner, who is a canadian citizen are planning to get married to facilitate our upcoming immigration to Sweden in autumn. But for the purpose of working during summer in Canada, will my case be considered differently if we get married soon. Should I make efforts to apply for residency in Canada for this and future purposes, for the event that we move back in the coming years ?

Grateful for responses and thoughts

The only time that marriage to a Canadian would affect work permit eligibility is in the context of an inland spousal sponsorship application. In such, following approval-in-principle, the foreign national would become eligible for an open work permit. Otherwise, there is no direct benefit.
