My company was late in applying for my LMO due to which I have to leave Canada (since my work permit was expiring). However, now since my LMO got applied on 4th November 2011, I would like to know how long would I have to wait to receive a reply for LMO and also the work permit, so that I can make my plans of travelling back to Canada.

I would also like to know that since my company is not having its own entity in Canada (it is a US based company and we cater to Canadian client), are there any possibilities of getting a negative LMO on the grounds of not being a Canadian entity. Till now, I have been working on a valid Work Permit and never had to apply for LMO, since the Canadian IT programme had exempted LMO process.

The duration of the LMO process depends on the region and the circumstances of the case. In some regions, these are taking as many as 11 weeks at present. Realistically, it is safest to make plans to return to Canada once the approval is in hand.

It is not expected that a refusal would be issued on the sole basis of the fact that the company is non-Canadian. The details of the case would determine the acceptability of this presentation.
