LMO application question

Postby carol5 on Sat Jan 01, 2011 8:50 pm

My business is a food concession in the deli department of a supermarket. We ran it for more than 2 years(my wife and me). We hired some employees in past, but they always worked only few months and left fast, this year we will have a new store (same business) in the same town, and my wife has become pregnant. So I made an LMO application which the job title was food service supervisor(noc 6212) in Nov 2010, the person will take charge the old store (also I will have 1 or 2 part time employees in the store) and I will look after the new one(if necessary, he will take charge the new one as well ). However, Service Canada Office phoned me that I am not eligible to have the food service supvisor there,so they will approve just the food counter attendant (noc 6441) but supervisor because my business is small and I do not hire any employees so far. Actually, the person need to carry the supervisor duties and attendant duties both there, and I need a supervisor for the business really , so can I use other titles in 6212 but diffrent names, such as supervisor, food concession , or canteen supervisor.......?
thank you!

You can certainly resubmit using an alternate title, but it may not be reasonable to expect that this should have any bearing on the outcome of the case as the official will refer to the same 6212 definition in the assessment of the application. It is this definition, and not the title per se, that would typically be of overriding concern.
