Industrial Repairs

Hi,

We manufacture industrial equipment in the USA. Occasionally we have Canadian customers that need repairs, and often quickly.

The typical repair would take two days.

Do we need to obtain a work permit, and if so which type would best fit our situation?

Unless the equipment is under warranty, a Service Canada Confirmation (Labour Market Opinion) and a work permit would be required for any employee being assigned to do such work in Canada. You may use the online work visa assessment to supply all the details.

Hi David,

I have been reading all morning on this subject, and ran across a website
CIC from the Canadian government. The forum will not let me post the address but the atricle says that the Immigration and Refugee Protection Act (IRPA) of 2002 spicifically exempts "service repair people" from both the opinion, and the work permit?

I have briefly read through the act and have not found the exemption.

Do you know if maybe they revised the Act?

There are exemptions for warranty repair and certain cases of emergency service. Otherwise, the LMO and work permit is required.

One more question..

Somewhere it says that a US citizen can apply at the port of entry.

Does that sound right, and if so do you know about how long it takes?

US citizens can seek most types of work permits at a port of entry. This does not apply if a LMO is required.

A well presented case can be concluded in about 1 hour in most cases.
