We are a small software company in the US that sells software to equipment dealers in Canada. A customer can buy a training package from us where we send an independent contractor to the customer's site to perform the training. Duration is normally 3 days. Does this require a work permit?

This independent contractor has made several trips to different Canadian customers. The first one she did not have to obtain a permit. The second one she was stopped and required to obtain a permit at a cost of $150. If she is not required to have a permit, how can she get a refund of the amount she has paid?

There is not enough information here to make an accurate determination. The nature of the software, the contents of the sales agreement, and the documentation presented would all be factors in that requirement. The discretion of the officer would also play a role if the case was presented incomplete.
