HRSDC Confirmation

Postby AndrewM on Thu Sep 08, 2005 5:29 pm

Hi,

I am currently working as a Software Products Developer for a company in Toronto, I will be finishing with this company next week and would like to move to another company.

I understand that i can remain in Canada for the duration of the period that my current visa is valid for.

When i first came to Canada three years ago i had to get a validation from the HRSDC, they told that this is because i do not have a degree.

What i would like know is:

Since i have been in Canada i have married a Canadian citizen who will be sponsoring me for permenant residence. If i change my job will i still need to apply for a new validation from the HRSDC, or will they let me transfer my existing one to the new employer.

Regards

Andrew.

If you required HRSDC Confirmation for the reason stated three years ago, then the likelihood is high that you would require it at present as well. However, depending on your nationality and the other details of your academic qualifications, it is possible that you may have become eligible for a confirmation exemption since that application was concluded. A review of the details of your case would be necessary to determine that.

One other alternative that may be available based on the information provided is that you become eligible for an open work permit after an approval-in-principle is rendered in an inland sponsorship case. However, if the sponsorship is yet to be submitted, it may be several more months before such an approval is issued.

Since I am now married would that not add extra points to the skilled worker application, since i can now use my spouses qualifications, work and student experience, and the fact that she is Canadian.

Yes, you may earn additional points in a skilled worker application, but that has no bearing on your eligibility for a Canadian work permit.
