Hello,
Here is my situation, I am a US citizen that has a job offer with a Canadian firm managing a telecommunications equipment authorization lab testing and approving products according to US and Canadian government regulations. The firm would like to use the NOC 9990.7 job description to bring me in quickly.

Here is my dilemma, as I read the wording of the regulation it seems only applicable to software engineers. I work with at least 5 items in each column of the job description list and will be testing products that fit into each column for clients seeking government approval of their devices, but I do not write the software for these products.

Would I still be eligible for this job description even though I do not write the software? The salary range for this job description is lower than what the lab is offering me to manage the firm. Would the immigration office deny the request if the salary is out of the range of the job description?

The program that you are referring to is oriented towards software development occupations. If the position being offered to you does not entail any such component, then you would likely be required to consider alternate approaches, which may include those of NAFTA or HRSDC Confirmation.

If the offered salary is above the range specified in the program, it may still be otherwise possible to qualify.
