I am working in Canada for the past 14 months. My work permit expired in Feb 2011 and my attorney has filed the application (before the expiry date of my WP) to extend my WP for another year. As per the immigration laws I am legally eligible to stay and work while my WP extn is in progress. I have a letter from my attorney stating the same. So I continue to work in Canada. My wife went to India even before her first dependent VISA expired. Now, can she apply for a dependent visa from India while my WP extn is still in-progress? Please give me directions.

An application is possible but is not likely to be approved prior to the issuance of the new work permit however.
