common law sponsorship

Hi there,

I am a UK citizen who will be living in Canada with my Canadian boyfriend for a year, I have an open work visa and am hoping to apply for common law relationship status. However my boyfriend has previously been married, and has therefore sponsored before. I read that there must be a 3 year period in between each sponsorship.

1. I am unsure whether this is from the marriage date or the date of permanent residence?
2. Whether the 3 years includes the year we will be living together or whether it's from the date of our application or the beggining of us living together?
3. Additionally would he have to be divorced for our common law relationship to be recognised?
