change in status help

Postby nayr37 on Tue Feb 02, 2010 1:45 am

Hi!

I would appreciate some advice for those who have been down the road, atm Im driving blind. lol

Im Aussie. Working Holiday. University Educated. Skilled Job. Working full time.

My Partner. Japanese. Working Holiday. Unemployed. Visa about to expire.

Im not sure the solution to keep her in the country, working.

I figure its easier for me to change my status and have her down as my common law? Do I or Can I, on a working holiday, ''Apply to change conditions or extend my stay in Canada'' ...or do I have to apply for an initial work permit and go through the LMO process? (even though I already have a job)

PR is something I am prepared to do also, But in all honesty I dont plan to be here for much more than another 18months.

thank you for any help.

cheers!

You must obtain a work permit of 6 months or more with a high skilled designation in order to allow your common-law-partner (i.e., assuming you can document cohabitation for 12 months) to obtain an open work permit for the same duration. As you are presently a work permit holder (but without any skill designation) you have the option of pursuing such via a port of entry, visa office abroad, or inland case processing centre.

You will likely need to have a Labour Market Opinion approval prior to seeking the work permit.
