Canada Work Permit Outcome after PR was cancelled

Postby neoethan on Mon Mar 08, 2010 11:23 am

Hi All,
Please can you help me out? I am really in a dilemma. On Aug 2008, I filed for my PR for Canada. The file was picked up by Canada Consulate on Feb 2009 cancelled my request stating that I was ineligible for the categories mentioned by the amended law on Nov 2008( New Categories for Job Criteria) . I was eligible if the new laws were not put in place. They refunded me the money for the visa.
I recently got a job offer from Canada and they are willing to file for my Work Permit. But once they came to know that I had previously filed for my PR they are saying that it will mostly be rejected, as the consulate might not be convinced that I will leave the country after my Work Permit Expires.

Although my company is willing to go ahead and file for the Work Permit

My questions are .
1. Should I take any extra care for this kind of scenario, for eg should I show the consulate extra asset in my home country.

2. What are the chances of rejection in a situation like this?

3. If my Work permit gets approved will I be eligible for a PR after 2 years.

Please help me out in this situation.
Thanks in advance for the quick response.

In any application for a work permit, the immigration officials must be satisfied that the candidate has an intent to depart Canada if required to do so. Being on record as pursuing permanent resident status is a consideration, but not necessarily one that is critical to the case. We have had numerous clients who have sought work permits while permanent resident applications were in process, and this has not been a negative in those cases. Care must be taken to clearly present an intent to depart Canada if need be.
