Can I apply with a temporary foreign worker visa for PR?

Postby awes-karma on Mon Oct 11, 2010 6:37 pm

Hello,

I am wondering why the permanent residence forum is locked but I hope to find some help here:-)

I am a German citizen and came to Canada in April 2009 with a work and travel visa. In April 2010 I extended my stay with the young professional visa. What can I say? I love Canada and I would like to stay. Here are my questions:

1. On December 8, 2010 I will complete the required one year of work experience in the NOC category 0, A or B (for the skilled worker application). Can I apply for a permanent residence on December 8th even though my current work permit expires in April 2011? (Somewhere I read that my current visa has to be still valid until there is a decission been made on the PR application).

2. If I need a work permit in order to apply for my PR, will I have to do the LMO for the PR application again- even though I will work for the same employer?

Thank you so much for your great help. This whole immigration process is really quite confusing:-)

Happy Thanks giving to everyone!

To benefit from Arranged Employment as a Skilled Worker, you may need a work permit valid at the time of the application for PR and at such time as the case is ready for conclusion; this could be based on extension/renewal of a given work permit as opposed only to a work permit that is valid for that entire duration. If renewal is a requirement, then a new LMO would typically be required (if originally required in your case). However, other provisions exist, such as the Canadian Experience Class and Arranged Employment Opinions, and so it is not clear what the requirement in your case will be.

Hi awes-karma,

I am currently here on a working holiday visa and I was wondering how I would go about extending my visa with a young professionals visa?

Is it true that you have to leave Canada for 12 months before you are eligible for the young professionals visa?

any help you or David could give would be greatly appreciated. I am an Irish citizen and my g/f is Canadian! Dont want to have to leave!

Hello Awes-Karma,

I actually have the same question like c_fly1. I am in canada on a working holiday visa right now and I would like to extend it with a young professional visa. I do have an employer for this visa already. I was just wondering how long the break between those 2 visas needs to be? Is it enough if I just leave canada for a few days?

I would really appreciate your answer.

Thanks
Nadin
