Application for Work Permit for A New Employer

Good day, I am presently working at a company here in High River, Alberta. My temporary work visa has expired on February 24, 2011 but prior to its expiration, my employer was able to apply for the extension of work permit. To date, I am still waiting for the release of my extension of work permit which might take up to July 2011 owing to the 139 days processing time.

The problem is I have received a job offer from a new company last April 2011 and I have accepted it. The new company already secured an unnamed LMO and applied for my name as TFW which will take only about five business days. Now, after that, I have to apply for a work permit.

Q1: Will the CIC process my request for new work permit in spite of the fact that I have a pending request for extension of work permit with my present employer?

Q2: Would it be okay if I apply for a Restoration of Status (considering my extension for a work permit is still pending and that I can consider to have lost my status for less than 90 days) and apply then for a work permit with new employer?

Q3: Will thre restoration of status and new work permit application automatically cancel my pending request for extension?

Please help. I need your advice badly. Any replies to this will be much appreciated! Thank you.

A restoration application would not be needed if an inland renewal application had been filed prior to the expiration of the work permit. CIC will process the new request, but any such application should be clear about the circumstances and the desire for the new application to supersede the prior one.

Thank you so much David! I thought I gotta turn the new offer of employment down because of my present situation. By the way, my temporary resident visa expired last February 4, 2011 and the extension of work permit was applied on February 20, 2011, four days prior to the expiration of work permit on February 24, 2011. What does matter in CIC, the expiry date of the TRV or the WP? Do i need to renew my TRV or it goes along with the renewal of WP? Also, I have read that the extension of WP must be filed at least 30 days prior to the expiry date, in my case where it was filed 4 days prior to WP expiry, would it have any implication for CIC processing for not meeting the required 30 days? Right now, I am still keeping my fingers crossed, the 139 days processing would end in July 2011, I have to wait that long while waiting also for the LMO from new employer which naming is on-process along with my contract.

One more thing, If I avail of the services of a third party for a new work permit for new employer, how much would it cost me?
