American with Canadian spouse, wish to work / immigrate

I am marrying my finacee in BC next month. It is our desire to live togther in BC instead of here in the US where we are now. My spouse is not eligible for work in the US and thus it is in our interest to move to BC (not to mention to be able to take care of her mother who is elderly. My spouse and I are the same gender (female) so that is also a reason to wish to live in BC.

Our issues are that alone, my finacee could not support me without help. Together, we can make a comfortable income. Neither of us have college degrees. Only I have a HS degree. We want to start a business in BC (web design and possibly hosting).

In the immediate time period, I would like to simply live and work in BC. In the future, say a couple / few years, immigrate to Canada. What are our options? One lawyer suggested the Humanitarian and Compassion route as same sex marriage is not permitted in the US and we would be taking care of her mom.

If you reside together, either in Canada or outside, then one possibility would be to apply as a common-law partner. The Skilled Worker program may be an alternate consideration if income proves to be an issue, but the education you have stated may cause a sufficient shortfall in points to disqualify you. H&C may be an option, but the decisions regarding such cases are highly discretionary, which means that a certain level of risk exists.
