A special case with a few questions

Postby smurff4 on Sat Mar 26, 2011 6:56 pm

I apologize if any of my questions have been answered before, however, I was only able to find answers to a couple of questions in the forums. My questions span the work permit as well as PR, so I was unsure which forum to post in. I really hope that someone can offer some guidance as lawyers and CIC have not been able to give me direct answers.

I am on a Post Grad Work Permit right now which expires in August 2011. I applied for PR in March of 2010 and received a letter in October of 2010 that I was denied because apparently my NOC specifications didn't match my work duties and that the work letter was not specific enough. I was unsure of which NOC number to use, so I had emailed and that was the number they gave me. Upon further research after receiving the denial, I discovered what the correct number was supposed to be. I sent an email to the Buffalo office as they do not receive calls, but I received no response to any of my emails. My former employer stated that they are willing to provide me with a more detailed letter of my duties which would clearly show that I meet the NOC requirements. We are still a bit confused which one to specify as my duties span NOC 2282 User Support Technicians and 2255 Mapping and Related Technologists and Technicians.
I have been trying to gain help with this situation for months now, with no one who can provide me a detailed response, everyone seems to not know what to do as apparently I would've been able to appeal, but that option was gone 60 days after receipt of the denial response.

I am started an online internship with a Canadian company and another job with a new employer at a small Engineering firm, and although they are hiring me because they consider me the best candidate, that doesn't mean that a Canadian is completely incapable of doing the job (which I have read to be the requirement for LMO).

With these circumstances in mind, my questions are:

1. Should I re-apply for PR with the correct letter from my former employer?
2. Does the processing time take longer for someone applying a second time for PR?
3. What should I do about my online internship and my job at the firm since my WP expires in August and PR would not be completed by then?

Thank you in advance for your time and response. I really appreciate any advice that you can offer.

Your only option is a new work permit application; I do not expect that successful appeal was ever a realistic option. Inclusion of supporting documents that accurately reflect your work history are needed. The processing of such would not take more or less time than a standard application.

In order to continue to work in Canada, assuming that your PR status is not granted prior to the expiration of your current work permit, a new or renewed work permit will be needed. This may be subject to the requirement of a LMO approval.
